Artist Cafe is operated by Hall Pass International, based in New Mexico, USA. These policies apply to all users of artistscafe.xyz worldwide.

Terms of Service
1. Acceptance of Terms
By accessing or using the Artist Cafe website ("Site") or any services provided by Hall Pass International ("Company," "we," "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Site or our services.
2. Eligibility
You must be at least 18 years of age to apply for membership or use our services. By submitting an application, you represent and warrant that you meet this requirement.
3. Membership and Billing
Artist Cafe offers membership on a subscription basis at $99 per month or $999 per year. Membership grants access to the services described on the Site, including music distribution across major platforms. Payment is due at the beginning of each billing cycle. Fees are non-refundable except where required by applicable law or as otherwise stated in a separate written agreement.
We reserve the right to change pricing at any time. Existing subscribers will receive at least 30 days' notice before any price change takes effect on their account.
4. Cancellation
You may cancel your membership at any time by contacting us at artistscafe@hallpassinternational.com. Cancellation takes effect at the end of the current billing period. No partial refunds will be issued for unused portions of a billing cycle unless required by law.
5. Content Ownership and License
You retain full ownership of all music, artwork, and other content ("Your Content") that you submit through Artist Cafe. By submitting Your Content, you grant us a non-exclusive, worldwide, royalty-free license to distribute, reproduce, and display Your Content solely for the purpose of providing the distribution and marketing services described on the Site.
This license terminates upon cancellation of your membership, subject to any existing distribution agreements with third-party platforms that may require a reasonable wind-down period.
6. Distribution Disclaimers
Artist Cafe facilitates distribution to third-party platforms (e.g., Spotify, Apple Music, YouTube). We do not guarantee placement on any editorial playlist, algorithmic recommendation, or featured position. Editorial pitching and verification submissions are discretionary, effort-based services with no guaranteed outcomes. Platform approval of verification requests is decided solely by the platform.
7. Limitation of Liability
To the maximum extent permitted by law, the Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Site or services, including but not limited to loss of revenue, data, or goodwill. Our total aggregate liability for any claims arising under these Terms shall not exceed the total amount you paid to us in the twelve (12) months preceding the claim.
8. Indemnification
You agree to indemnify and hold harmless the Company, its officers, employees, and agents from any claims, losses, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the services, your violation of these Terms, or your violation of any third-party rights.
9. Dispute Resolution
Any disputes arising under these Terms shall first be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration administered under the rules of the American Arbitration Association, with proceedings held in New Mexico, USA. You waive any right to participate in a class action or class-wide arbitration.
10. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of New Mexico, USA, without regard to conflict-of-law principles.
11. Termination
We may suspend or terminate your membership at any time for any reason, including violation of these Terms, with or without notice. Upon termination, your license to use the services ceases immediately. Sections 7, 8, 9, and 10 survive termination.
12. Changes to Terms
We reserve the right to update these Terms at any time. Material changes will be posted on this page with an updated "Last updated" date. Continued use of the Site after changes constitutes acceptance of the revised Terms.
Privacy Policy
1. Information We Collect
We collect information that you voluntarily provide when applying for membership or using our services, including:
- Name and email address
- Artist or stage name
- Links to social media profiles (Instagram, Twitter/X, TikTok, etc.)
- Links to music on streaming platforms
- Any additional information you include in your application
We also automatically collect certain technical data when you visit the Site, including IP address, browser type, device information, pages visited, and referring URL, through cookies and analytics tools.
2. How We Use Your Information
- To process and evaluate your membership application
- To provide distribution and marketing services
- To communicate with you about your account and our services
- To improve the Site and our services
- To comply with legal obligations
3. Third-Party Services
We use the following third-party services that may process your data:
- EmailJS — to transmit application form data
- Analytics providers — to understand Site usage and improve our services
- Distribution platforms (Spotify, Apple Music, YouTube, Amazon Music, TikTok, etc.) — to deliver your music as part of our services
Each third-party service operates under its own privacy policy. We encourage you to review them.
4. Data Retention
We retain your personal information for as long as your membership is active, plus a reasonable period afterward to fulfill legal, accounting, or reporting obligations. You may request deletion of your data at any time (see your rights below).
5. Data Security
We implement commercially reasonable technical and organizational measures to protect your data. However, no method of transmission over the internet or electronic storage is completely secure, and we cannot guarantee absolute security.
6. Children's Privacy
Our services are not directed to individuals under 18 years of age. We do not knowingly collect personal information from children. If we learn that we have collected data from a person under 18, we will delete it promptly. This is consistent with the U.S. Children's Online Privacy Protection Act (COPPA).
7. Your Rights — United States
Under U.S. federal and applicable state laws:
- We comply with the CAN-SPAM Act: you may opt out of marketing emails at any time by following the unsubscribe link or contacting us.
- We do not sell personal information as defined under applicable U.S. privacy laws.
California Residents (CCPA/CPRA)
If you are a California resident, you have additional rights under the California Consumer Privacy Act and California Privacy Rights Act:
- Right to know — You may request the categories and specific pieces of personal information we have collected about you.
- Right to delete — You may request that we delete the personal information we hold about you, subject to certain exceptions.

- Contract performance — Processing necessary to fulfill our membership agreement with you.
- Legitimate interests — Improving our services, fraud prevention, and analytics, where these interests are not overridden by your rights.

If you believe we have not adequately addressed your data protection concerns, you have the right to lodge a complaint with your local data protection supervisory authority.

Regardless of where you are located, you may contact us at any time to:

Reservation of Rights
1. Company Intellectual Property
All content on the Site — including but not limited to the Artist Cafe name, logo, brand marks, site design, text, graphics, and software — is the intellectual property of Hall Pass International and is protected by U.S. and international copyright, trademark, and other intellectual-property laws. You may not reproduce, distribute, modify, or create derivative works of our content without prior written permission.
2. Artist Content Ownership
Artists retain full ownership of their music, artwork, and other creative works submitted through Artist Cafe. The license granted to us under the Terms of Service is limited to the scope necessary to provide our distribution and marketing services and does not constitute a transfer of ownership.
3. Right to Modify
We reserve the right to modify, suspend, or discontinue any aspect of the Site or services — including features, pricing, membership tiers, and these legal documents — at any time, with or without notice. Where practicable, we will provide advance notice of material changes.
4. No Waiver
Our failure to enforce any provision of these Terms or policies at any time does not constitute a waiver of that provision or our right to enforce it in the future. All rights not expressly granted herein are reserved by the Company.
5. Severability
If any provision of these Terms or policies is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
Do Not Sell My Personal Information
Our Commitment
Artist Cafe / Hall Pass International does not sell your personal information to third parties, as defined under the California Consumer Privacy Act (CCPA), the California Privacy Rights Act (CPRA), or any other applicable law.
What "Sale" Means
Under the CCPA/CPRA, a "sale" includes disclosing personal information to a third party for monetary or other valuable consideration. We do not engage in this practice. We also do not "share" personal information for cross-context behavioral advertising purposes.
Submitting a Request
Even though we do not sell your data, if you wish to formally exercise your right to opt out, you may do so by contacting us at artistscafe@hallpassinternational.com with the subject line "Do Not Sell My Information."
We will acknowledge your request within 10 business days and complete processing within 15 business days.
Verification
To protect your privacy, we may need to verify your identity before processing your request. We will ask you to confirm identifying information associated with your account (e.g., your email address or artist name).
Worldwide Applicability
While the "Do Not Sell" right originates in California law, we extend equivalent protections to all users worldwide. European users may exercise their right to object under the GDPR, and users in other jurisdictions may exercise comparable rights under their local laws, by contacting us at the same email address above.
